Since 1971, OSHA has used the General Duty Clause {Section 5(a)(1) OF THE OSHA Act} in Construction to address hazards not found in OSHA’s 29CFR1926 regulations. This ses-sion will discuss the most commonly cited violations used in construction and the hazards involved. An introduction of the elements needed by OSHA to issue a citation under a General Duty Violation will be discussed.
